General Terms & Conditions

  1. All customer related queries should be directed to the pertaining Hotel.
  2. Refer to the Tsogo Rewards programme Terms and Conditions for the hotel programme.
  3. Should you make a booking through an associated partner’s reward programme you will only qualify for and may elect either the discounted rate as agreed to between the associated partner’s reward programme and Tsogo Sun, or the hotel rewards programme discounted rate as determined by Tsogo Sun. Under no circumstances will a booking qualify for both rates.

Hotel Reservations

  1. Payment for any reservations or other services for which fees may be charged by Tsogo Sun shall be payable by you on departure from the hotel in question or, where applicable, shall be debited to your account after departure.
  2. The rates payable by you in respect of the provision by Tsogo Sun of any services and/or goods, including but not limited to the provision of accommodation at the hotel of your choice, shall be the current applicable rates of the particular hotel specified by you. Those rates are available from the hotel itself.
  3. Non Refundable Rates /or Refundable Rates
    Payment going through our Payment Gateway will secure full payment and debit the credit card used in making the booking. “The credit card used to confirm and pay for a reservation is required to be presented on check-in at the hotel. An imprint of this card will be taken by the hotel on check-in in order to prove the card was present.”
  4. Other Rates
    Credit card details on the website is merely to secure a reservation, and does not constitute payment in respect of the services to be provided by Tsogo Sun. Tsogo Sun reserves the right to debit your credit card with a cancellation fee equal to 1 nights’ accommodation, if a reservation is not cancelled by 18h00 (hotel time) on the day of arrival.
  5. The customer/client hereby agrees that this transaction constitutes an electronic transaction as defined in the Electronic Communications and Transactions Act 2002 and that a binding agreement has been concluded between the Hotel and the customer/client authorising the Hotel to deduct or to debit the credit card for payments for services rendered to the customer/client. The hand signature of the customer/client shall not be required for authorisation purposes.

  1. All rates are quoted in South African Rand and include Value Added Tax (VAT) at the prevailing rate. Rates exclude 1% Tourism Levy charged per night, per room. Unless indicated otherwise.
  2. Subject to the availability of rooms, Guests may check-in from 14h00 on the arrival date and must check-out by no later than 11h00 on the departure date.
  3. Due to the Immigration Amendment Act no.19 of 2004, positive personal identification will be required at the time of making your booking or upon check-in. A valid Passport or an ID Document will be acceptable.
  4. Queen and King rooms can accommodate up to 2 guests and rooms with two Double beds can accommodate up to 2 adults and 2 children only.
  5. Room types are subject to availability at the time of booking.
  6. Day use rooms are reserved strictly on request and subject to availability.
  7. Rates are subject to change without prior notification.
  8. All Reservations require a guarantee or deposit in lieu of a guarantee, as indicated herein. If a guarantee or deposit has not been supplied by the time specified, the relevant Reservations(s) may be cancelled without notice.
  9. In order to guarantee the reservation, the following must be provided:
    • Pre-payment as indicated on this confirmation of the reservation; or
    • Details of one of the following recognised credit cards: Master Card or Visa.
  10. The hotels reserve the right to retain a cancellation fee equal to 1 nights’ accommodation if a reservation is not cancelled by 18h00 (hotel time) on the day of arrival. This amount will be charged to the bookers’ credit card.
  11. Full payment is due upon check-in, unless indicated otherwise.
  12. No complimentary rooms and no commission structures are applicable.
  1. All information provided by you in connection with the use of the booking platform, particularly, but not limited to, making a Reservation, shall be true and accurate and may be relied upon as such.
  2. Rates are subject to availability and fluctuations.
  3. Rates are per night sharing on a per person or per room basis, as indicated.
  4. Rates are for accommodation only unless otherwise specified.
  5. “B/B” denotes bed and breakfast.
  6. “D/B/B” denotes dinner, bed and breakfast.
  7. These rates are only available for transient business and are not available for groups or conferences. Bookings for 9 rooms or more constitutes a group and rates are available on request from the relevant hotel. Group bookings are subject to separate terms and conditions which will be communicated to you prior to the time of booking.
  8. All Rates are nett and non-commissionable.
  9. The credit card used to confirm and pay for a reservation is required to be presented on check-in at the hotel. An imprint of this card will be taken by the hotel on check-in, in order to prove the card was present. If your transaction requires further authentication e.g. Payment confirmation on your phone or an OTP (one time pin) then this transaction will be 3D authenticated by your bank and your credit card will NOT be required to be presented on check in.
  10. All accommodation provided in terms of any booking made on this website will be subject to the standard Terms and Conditions of Residence of the hotel concerned.
  11. Check-in time is from 14h00 on the day of arrival, and check out time is by 11h00 on the day of departure (hotel time).
  12. Certain special promotions and rates carry their own terms and conditions as indicated in the rate description, which apply accordingly,

    • All Reservations require a guarantee or deposit in lieu of a guarantee, as indicated in the rate description. If a guarantee or deposit has not been supplied by the time specified, the relevant Reservations(s) may be cancelled without notice, and we reserve the right to provide the relevant Reservation(s) to another person (e.g., to re-let the relevant room or facility in case of accommodation booking) without prior notice. In such circumstances, we will not be obliged to refund any deposit paid by you (or by any other person in connection with the Reservation).
  15. Please check the rate description prior to booking to determine the applicable refund policy;
  16. Please note that for rates that do not require pre-payment, you will not be charged if you amend or cancel this booking before 11h00 (hotel time) on the day of arrival.
  17. Cancellation:
    • Certain rates are subject to a cancellation fee should the reservation be modified or cancelled. Please check the rate description prior to booking to determine the applicable cancellation policy.
    • The Hotel reserves the right to retain a cancellation fee equal to 1 nights’ accommodation if a reservation is not cancelled by 18h00 (hotel time) on the day of arrival. This amount will be charged to the bookers’ credit card.
  18. By accepting the Hotel key/key card and signing the Hotel registration card when checking in, you expressly agree to be bound by these terms and conditions of residence at the Hotel.

  1. All references to “T/the Hotel” include the owners and managers/operators of the Hotel property and business, their tenants, holding and affiliated entities, licensors, the body corporate (if applicable) and all their members, directors, officers, employees, managers, agents, representatives and contractors.
  2. An expression which denotes any gender includes the other genders, a natural person includes an artificial or juristic person, including the State and vice versa and the singular includes the plural and vice versa.
  3. The Guest, by signing the registration card, warrants [guarantees or promises] that he is duly authorised to sign for and bind all persons represented by him and/or for whom he is responsible and/or for whom he is arranging accommodation at the Hotel (“his party”) to these conditions of residence and, failing such authority in respect of any member of his party, agrees that, in addition to any other remedies the Hotel may have against him, for breach [an act of breaking or failing to observe] of this warranty, to be personally liable for all amounts arising from the residence and/or use of the facilities and consumption of goods by him and his party at the hotel and hereby indemnifies [absolves the Hotel from responsibility to compensate for the loss occurred to the other party ] the Hotel against any claim made by any member of his party against the Hotel, as set out/contemplated in clause 12 below.
  4. The Guest agrees to provide the Hotel with any identification and information reasonably required by the Hotel to enable it to comply with any prevailing legislation applicable to the Hotel.
  5. The Hotel may be monitored by CCTV and the Guest and his party hereby agree thereto.
  6. Smoking anywhere on the Hotel premises (other than in areas designated for this purpose) is strictly prohibited and the Hotel shall be entitled to charge the Guest a reasonable cleaning fee for cleaning of any area or room affected by the Guest’s non-compliance herewith.
  7. The Guest accepts full liability for all additional charges (extras) incurred by him and his party during their tenure at the Hotel. and agrees to pay, by no later than the time of departure (unless prior written arrangements have been made with the Hotel management) the room rate, the cost of food, beverage, use of facilities and any other amounts relating to such residence, incurred by the Guest and his party during his/their stay at the Hotel. Periodic payments must be made if the account exceeds the credit limit designated by the Hotel, and accounts are payable on presentation, even prior to the departure date. The Hotel reserves the right to require guarantee of payment by means of the Guest providing a credit card number with the expiration date and CVV number valid at the time of the Guest’s stay and the guest producing the actual plastic credit card. Should the Guest wish to shorten his stay at the Hotel, the Hotel shall nevertheless be entitled to charge the Guest for each night’s stay reserved, as a cancellation fee. Any queries in respect of specific invoices shall not affect immediate payment of any other outstanding amount.
  8. The Guest and his party undertake to vacate his/their room/s by the check-out time indicated on the registration card on the date of departure and to return all keys/key cards to reception. Any late check-out is subject to availability and may only be by prior arrangement with the Hotel and the Hotel will be entitled to charge the Guest for an additional night’s stay at the Hotel.
  9. A certificate from the Hotel manager shall constitute [be] prima facie proof [deemed to be correct until the contrary is proved] of the indebtedness of the Guest and/or his party and of the particulars therein for all purposes, including any action instituted by the Hotel against the Guest and/or any of his party.
  10. The Guest agrees that after his departure, the Hotel may retain goods left behind by him and/or his party and authorises the Hotel, after giving one month’s notice to the domicilium address referred to in clause 18, of its intention to do so, to sell same privately or publicly at the Hotel’s discretion, at such price as the Hotel may determine and off-set the proceeds of such sale against the indebtedness of the Guest and/or his party and any balance shall be deemed to have been forfeited to the Hotel. The Hotel shall furthermore be entitled to charge the Guest a reasonable fee in respect of such period of time for which the items are left at the Hotel. The Guest and each of his party agree that the Hotel shall have a lien (a right to keep possession of property belonging to another person until a debt owed by that person is discharged) over all items brought by any of them onto the Hotel premises, for all amounts due to the Hotel by any of them, no matter how and when such debt was incurred.
  11. When eating any food upon the Hotel premises, the Guest and all members of his party hereby acknowledge that should they suffer from any allergy or other problem with the ingredients of such food, they will be solely [only] responsible to point this fact out to the relevant Hotel representative. Any illness or malady suffered by the Guest or any member of his party shall be their sole responsibility. The Hotel shall not be responsible for any medical or other costs, howsoever arising, for the treatment of such illness or malady.
  12. The Guest hereby agrees, on his behalf and on behalf of the members of his party, that it is a condition of his/their residence at the Hotel and/or use of the facilities at the Hotel Property and/or his/their participation in any activity offered by the Hotel (whether such facilities/activities are provided/operated by the Hotel or an independent contractor), that the Hotel shall not be responsible for any injury or harm to or death or illness of any person (or any child under 18 for whom he is responsible) or for the loss or destruction of or damage to any property or any loss of money or other valuables or loss or damage/s of any other kind (as well as that of any child under 18 for whom he is responsible), including, but not limited to, loss of profits, pure economic loss [financial loss and damage], other monetary loss or a claim for loss of support or any damages of any other kind for anything occurring upon the premises of the Hotel, whether arising from fire, theft, drowning or any other cause of whatsoever nature or kind and by whomsoever caused, whether arising from the negligence or wrongful act of any person in the employ of or contracted to the Hotel or otherwise. The Guest and his party hereby waive all such claims and furthermore hereby indemnify and hold harmless the Hotel and such persons against any claim, as contemplated above, that may be made against the Hotel or such persons by the Guest, his party or any person occupying the room together with the Guest or any invitee of the Guest.
  13. The Hotel does not accept any responsibility or liability for the safe custody or loss of or damage or destruction to any money, valuables or other property stored or left in the room, room safe and/or on any other part of the Hotel premises, whether as a result of negligent or other wrongful act of any person, whether in the employ of the Hotel, contracted to the Hotel or otherwise or from any other cause whatsoever and howsoever arising. Further the Hotel does not accept any liability or responsibility for any claim resulting from a failure of the electricity, water (whether as a result of drought or otherwise) or other utility supply, the failure of backup generators or reservoirs and whether or not caused by the Hotel’s negligence.
  14. The Guest agrees to abide by the Hotel’s rules, regulations and security requirements prevailing at the relevant time and any failure to comply therewith or disorderly conduct on the part of the Guest or any member of his party or any invitee shall entitle the Hotel to insist that the Guest and his party/invitee/s vacate the Hotel premises as right of admission to the Hotel premises is at all times reserved by the Hotel. In such an event, the Guest shall not be entitled to claim any refund of any amount pre-paid or any damages or compensation of whatsoever nature.
  15. The Guest shall be responsible for any damage or destruction caused to the Hotel’s premises, allocated rooms, the furnishings, utensils and equipment therein, by any wilful act, default or negligence and shall be liable to pay for such damages.
  16. All the information contained in any website, brochure or catalogue (or which accompanies or forms part of any offer made by the Hotel), is subject to alteration at any time without prior notice and the Hotel will not be bound to comply exactly therewith. The Hotel shall not be liable for any inaccuracies in any website, brochure or other information supplied by it and shall not be liable for any accidents or happenings arising out of such faulty information.
  17. The Hotel reserves the right to cancel any booking forthwith and without any liability [a responsibility or duty] on its part in the event of any damage to, or destruction of the allocated rooms or facilities by fire or other cause, any shortage of labour or food supplies, strikes, lockouts, industrial unrest, load-shedding, cessation of any essential services, outbreak of illness, epidemic, pandemic, government regulation droughts or any other causes which shall prevent it from performing its obligations in connection with any booking. In these circumstances, where appropriate, the Hotel will make every effort to accommodate the Guest elsewhere within its group, but will not be liable if it fails do so.
  18. The Guest and all members of his party choose as their domicilium citandi et executandi [the address at which you will accept service of all notices and court process] (“domicilium address”) for all purposes at the residential address or guest email address set out on the registration card.
  19. Notwithstanding the amount which may at any time be owing, the parties consent to the jurisdiction of any inferior court in any action or proceeding otherwise beyond its jurisdiction, it being understood however that the Hotel shall at all times be entitled to bring any such action or proceeding in any superior court of its choice. If any such actions be necessary, the Guest agrees to pay all costs and disbursements as between attorney and client [all costs the attorney is entitled to recover against his client] and collection or similar commission at the prescribed rate.
  20. The Guest shall not be entitled to cede [to surrender possession or give to another person] or assign [allocate or handover] the reservation to any third party nor utilise the Hotel’s facilities for any other purpose or person than that stated, without the Hotel’s prior written approval.
  21. The Guest shall not use the Hotel’s name or logo or any trade‑mark which the Hotel has the right to use, in any media or public forum or in any other way whatsoever, without the prior written consent of the Hotel first being had and obtained.
  22. No changes, alterations, variations or cancellation of any of these conditions shall be binding on Hotel, unless agreed thereto by the Hotel in writing and signed by a responsible officer on their behalf. These conditions and the Guest’s stay at the Hotel shall be governed by and construed [interpreted] in accordance with the laws of the country within which the hotel is located.
  23. No warranties [guarantees or promises] or representations, whether express or implied, not stated herein shall be binding on the parties. No waiver [voluntary surrender of a known right] made by the Hotel to the Guest shall be binding unless in writing and any such waiver shall be construed strictly as relating to the matter in respect whereof it has been made and no indulgence by the Hotel shall operate as an estoppel [preventing one from making an allegation or a denial that contradicts what he has previously stated as the truth] against it in respect of any rights hereunder, nor shall it operate so as to preclude [stop or prevent] the Hotel thereafter from exercising its rights strictly in accordance with these terms.
  24. If any provision herein is held to be unenforceable by any court of law, such provision shall be severable [capable of being divided or parted] from these conditions and shall not affect the remaining provisions, which shall remain of full force and effect.
  25. No provision herein shall be construed against or interpreted to the disadvantage of any party by reason of such party having or being deemed to have structured, drafted or introduced such provision or by reason of the extent to which any party or its professional advisors participated in the preparation of these conditions and accordingly the contra proferentem rule [broadly this means that where there is doubt about the meaning of the words in a contract, the words will be construed against the person who put them forward] shall not be applied in the interpretation of these conditions.
  26. The Guest by selecting the Sign up to the Tsogo Sun programme check box (where applicable), agrees to the Hotel Rewards Programme Terms and Conditions (available on www.tsogosun.com).
  27. The Guest recognises that he and/or his party may receive communication regarding offers and promotions from Tsogo Sun and understands that they can opt-out from these offers and promotions by following the unsubscribe instructions in each communication.
  28. As the Hotel may be obliged to collect personal information, the Guest hereby agrees and consents to the Hotel transferring his (and that of the members of his party) personal data so collected to the companies constituting the Hotel group and any authorities entitled to same. The Guest further agrees to such data being utilised by the Hotel for marketing and market-related research purposes, to the extent legally permissible.   7. Children under 18 (maximum 2) stay and eat breakfast free in hotel owned restaurants when sharing with their parents where family rooms are available.
  8. Non-Refundable Rates
    1. Certain rates require a non-refundable prepayment in order to be confirmed. Please check the Policies and Details when booking, to determine the payment policy.
    2. Reservations confirmed on a prepaid rate are in certain circumstances subject to 100% cancellation fee should they be modified or cancelled. Please confirm with the relevant hotel.
  9. Please note that for rates that do not require prepayment, you will not be charged if you amend or cancel this booking before 11h00 (hotel time) on the day of arrival (Booking Site).
  10. If a reservation made on a rate that does require prepayment, is not cancelled by 11h00 (hotel time) on the day of arrival, the guest is subject to a charge equal to one night’s accommodation. This amount will be charged to the guest’s credit card.
  11. The credit card used to confirm and pay for a reservation is required to be presented on check-in at the hotel. An imprint of this card will be taken by the hotel on check-in, in order to prove the card was present. If your transaction requires further authentication e.g. Payment confirmation on your phone or an OTP (one time pin) then this transaction will be 3D authenticated by your bank and your credit card will NOT be required to be presented on check in.

  18. Non-Refundable Rates – Payment going through our Payment Gateway will secure full payment and debit the credit card used in making the booking. Booking will be non-refundable on cancellation or amendments.
  19. Other Rates – Credit card details on the website is merely to secure a reservation, and does not constitute payment in respect of the services to be provided by Tsogo Sun. Tsogo Sun reserves the right to debit your credit card with a cancellation fee equal to 1 nights’ accommodation if a reservation is not cancelled by 11h00 (hotel time) on the day of arrival.
  20. Our preferred STO Partner agreement will supersede the generic Tsogo Sun Terms & Conditions relating to deposits, payments and cancellations for FIT bookings.

Payments

Book And Pay for Your Tsogo Sun hotel Accommodation Online

Tsogo Sun Hotels offer guests the safe, secure and convenient option of booking and paying for your accommodation online. There are a number of online payment options available.

  1. Credit & Debit Cards – The card used to confirm and pay for an online reservation is required to be presented on check-in at the hotel. An imprint of this card will be taken by the hotel on check-in, in order to prove the card was present. If your transaction requires further authentication e.g. Payment confirmation on your phone or an OTP (one time pin) then this transaction will be 3D authenticated by your bank and your credit card will NOT be required to be presented on check in.
  2. Reservation Amendments
  3. Should your reservation be amended or cancelled and had a part or full prepayment, a refund, subject to the booking payment terms and conditions, may be given.
  4. Depending on your banking institution, some debit cards will not be refunded, where this applies, the hotel at which the booking was made, will make contact with you to arrange a refund by bank transfer;
  5. Process payments online, where this applies, please either make use of a credit card, or make contact with the hotel at which you are booking to arrange an alternative payment method;
  6. Any booking cancelled 6 (six) months after the booking date, may not automatically receive a refund. This is due to financial transactions only being available in the online booking engine for a period of 6 (six) months as per banking regulations.  The hotel will make contact with you to arrange a refund;
  1. 3D Secure (3 Domain Security) – is a method of security mandated by the Card Associations to enhance the security of online transactions. Mastercard’s product is called “SecureCode”, Visa’s product is called “Verified by Visa” and American Express’ product is called “American Express Safekey”.
  2. For more information on 3D Security and for easy 3D secure registration please contact your bank and they will advise you of their specific process.

RESTAURANT RESERVATION REQUEST

  1. Please be advised that this is a reservation request only and is therefore not confirmed nor guaranteed.
  2. A Hotel Representative will be in contact with you during standard business hours (09h00 to 17h00, Monday to Friday, excluding public holidays).
  3. All Requests are subject to availability and tables are allocated on the day of the reservation.
  4. We will endeavour to honour your request, however cannot guarantee the date, time, number of people or special requests.
  5. Tables above 10 and certain special requests may require a credit card guarantee to confirm the reservation.
  6. At the discretion of the Restaurant Manager reservations may be cancelled due to non-arrival within 30 minutes of the requested time.
  7. Dress Code: Some restaurants have a dress code for guests to enjoy an experience that is trendy, elegant, and memorable.
